A Future Marriage

If the study of one's former marriage determines that the marriage-in-question was not a true bond according to the norms of the Catholic Church, then the First and Second Tribunals must declare that marriage null. This confirmed Decision establishes the right for either pary to enter into a new marriage within the Catholic Church. Once there have been two(2) Affirmative Decisions, the usual procedures for preparing for a marriage in the Catholic Church can begin.

However, not all cases receive an Affirmative Decision and Judgment. So no future wedding plans can be made until the case has been given an Affirmative answer by two Tribunals. Even if the First Instance gives an Affirmative, there is no guarantee the Second Instance will also do so. All must be held in abeyance until two Affirmative Decisions have been made.

If the Tribunal's study of the marriage reveals that there were some deep-seated problems that need to be addressed before the Petitioner and/or the Respondent can enter a new marriage in the Catholic Church, then meetings with the local parish priest and/or professional counselor will be required before permission for a future marriage would be given according to the norms of the Canons.

Because of all the variables regarding the time it actually takes to complete everything, and because not all cases receive Affirmative Decision, i.e., a declaration of nullity, and if they do receive an Affirmative there is also the possibility of the requirement of counseling, NO FUTURE MARRIAGE MAY BE SCHEDULED IN ANY CATHOLIC CHURCH UNTIL THE ANNULMENT PROCEDURE HAS RESULTED IN TWO AFFIRMATIVE DECISIONS AND ANY AND ALL REQUIREMENTS ARE COMPLETED.

If this Tribunal renders a Negative Decision, the Petitioner and/or the Respondent has the right to appeal that Decision to our Appellate Tribunal.
